On February 2, 2011, Officer Brad Cox was dispatched to Kelly Road, in reference to a vehicle in the ditch. Upon arrival, Officer Cox observed that Adel Richard Curry Jr. of Damascus had gotten back inside his vehicle after getting out of the vehicle and falling down in the road apparently intoxicated. Mr. Curry was asked to take a state administered chemical test of his breath by Deputy Dan Ricketson because he could smell alcohol on his breath, and he became argumentative with Deputy Ricketson. Deputy Ricketson took an inventory of Mr. Curry’s vehicle, while Officer Cox transported him to the Miller County Jail.

Upon arrival at the Miller County Jail, Mr. Curry became verbally abusive toward Detention Officer Ken Cooper and Deputy Ricketson. As Deputy Ricketson prepared to test Mr. Curry on the intoxilyzer Model 5000, Mr. Curry was asked to settle down several times, and he kept getting louder and louder with the officers. When it came time for Mr. Curry to submit to his breath sample, he verbally refused.

Mr. Curry also stated that he could not be charged with driving under the influence if he didn’t take the test. Citations was issued to Mr. Curry charging him with failure to maintain lane, open container, and driving under the influence of alcohol, less safe. Nothing further.
