Grand Jury on embracery

Editor's note: The following laws concerning tampering with a grand jury member was furnished by Chief Judge of Pataula Circuit when he furnished me with a list of the names chosen that may be selected for the August Miller County Grand Jury. I was requested to publish these laws if I published the names prior to Grand Jury day. I did not publish the names for obvious reasons. If any Miller County Grand Juror was contacted before or after the Grand Jury was in session concerning a case or influence on a case, they are asked to contact Judge Joe C. Bishop at 229-995-4994 or Clerk of Court Annie Laura Middleton at 758-4102.

16-10-91 . Embracery - An attempt to influence a court, jury, etc., corruptly, by promises, entreaties, money, entertainments, threats, or other improper inducements.

(a) A person commits the offense of embracery when he/she:

(1) With intent to influence a person summoned or serving as a juror, communicates with him otherwise than is authorized by law in an attempt to influence his/her action as a juror; or

(2) Summoned as a juror, accepts anything of value offered to him/her with the understanding that it is given with the intent of influencing his/her action as a juror.

(b) A person convicted of the offense of embracery shall be punished by a fine of not more than $1000.00 or by imprisonment for not less than one nor more than five years, or both.
